Big Win For Ruto As Court Of Appeal Dismisses Appeal Challenging Various Sections In Cybercrime Laws

The Court of Appeal has upheld the constitutionality of the Computer Misuse and Cybercrimes Act, 2018 in a decision that strengthens Kenya’s legal framework for digital security. 

The ruling confirms that the law remains valid and enforceable as the country continues to expand its digital space.

The judgment was delivered by a bench of three judges of the Court of Appeal: Patrick Kiage, Aggrey Muchelule and Weldon Korir. 

The court dismissed an appeal that had challenged several sections of the law and affirmed an earlier decision by the High Court which had found the Act to be constitutional.

Following the ruling, Foreign Affairs Principal Secretary Raymond Omollo welcomed the decision, saying it reinforces efforts to secure Kenya’s growing cyberspace. 

He noted that the country is experiencing rapid digital growth and that strong legal protections are necessary to guard against cyber threats.

Kenya has seen a major increase in online communication, digital services and internet-based business. As more citizens rely on digital platforms for work, education and trade, the need for proper regulation has become more important. 

Laws such as the Computer Misuse and Cybercrimes Act are meant to protect individuals, businesses and institutions from online crimes.

Omollo said the decision comes at a time when the government is implementing major digital development projects. 

The Digital Superhighway is one of the key programmes under the Bottom-Up Economic Transformation Agenda. The initiative aims to expand internet access, support digital jobs and improve government services through technology.
